Understand Your Rights And Obligations to Avoid Accident Claim Rejection?


When you buy a car insurance policy you feel assured that you are protected against any liability arising because of an accident. But unfortunately this is not entirely true and there are cases when accident claims get rejected. To avoid feeling cheated on account of such claim rejections it is important that you read the policy document thoroughly when you buy a car insurance policy.

You will realize that there are certain situations under which claims can be rejected by the insurance company even if you have paid your insurance premium timely. For the insurance company to honour a claim, you need to fulfill certain obligations which include:

1) You cannot drive when you are intoxicated or under the influence of drugs/alcohol. If the insurance company finds that the accident has occurred as the driver was intoxicated they have a right to reject your claim.

2) Make sure that you transfer the policy to your name in case you buy a second hand car – Your claim would be rejected if you meet with an accident while driving a second hand car that you purchased but did not get the car insurance policy document registered in your name.

3) You need to report the accident timely – You need to report to the insurance company about the accident within 10 days. A delay can lead to rejection

4) Do not make commercial use of a private car – If it is found that your personal car for which you filed an accident claim was being used for a commercial purpose (a cab, a goods carrier) your claim stand to be rejected. 

If you think your car accident claim was wrongfully rejected you have the right to approach the insurance ombudsman.
